The Jurinex Team conducts post trial juror interviews to document the accuracy of the juror profiles developed in jury selection and to determine the basis of the jury’s verdict. The jurors discuss their reactions to the evidence in private interviews which allow them to openly report their experiences during their deliberations. An understanding of their deliberations provides a gauge of the impact of each witness and evidence. This information is useful in arguing future cases or may provide a basis for an appeal.
ANALYZE
The juror interviews provide the opportunity for a post trial autopsy to analyze of the conduct of the trial and of the persuasiveness of each counsel’s arguments. The jurors are asked to identify the evidence(s) that had the most influence on their decision. Their reaction to the witness testimony and is discussed to determine the statements that carried the most weight. The effectiveness of the exhibits and the data presented are also measured.
IDENTIFY
The points identified by the analysis of each juror interview are examined in detail and then followed up on in each successive interview. If necessary, call backs are made to clarify items in question. This provides the support of multiple juror impressions to each significant item identified in each of the interviews. The importance of the factors affecting each juror’s decision is ranked and presented in tabular form.
SUMMARIZE
Jurinex will develop a report of the findings of the post trial juror interviews. The report will contain a ranking of the arguments the jurors felt to be most important in reaching their individual decisions. It will also report on the arguments presented by the jurors in their deliberations. Jurors often report on arguments that were ineffective or not plausible to the jurors. The consultant’s analysis of the findings will be presented in narrative and tabular formats.
Litigation cases often address similar issues. Therefore, the lessons learned by looking back on a case and analyzing the strengths and weakness of each argument from the jury’s view point is invaluable. The information can be applied to developing the case strategy for future litigation. It is also valuable to counsel in evaluating their litigation technique and developing methods of strengthening their effectiveness. The client can use the report to determine the issues the jurors found significant and can make changes to avoid similar litigation in the future.
